Grant of License
By using the image, you are agreeing to be bound by the terms and conditions of this License Agreement. If you do not agree to the terms of this Agreement do not install or use the image in any manner. The digital images offered for use herein are the copyrighted property of Dragonfly Photography, LLC; Dragonfly grants you a nonexclusive license to use the selected image(s) and no other rights. You may not resell, transfer, assign or in any way distribute any of the images unless they have been incorporated into a new and distinct product. The user understands that it is purchasing the rights to use a digital image whose characteristics may vary depending on software and hardware parameters employed by the user to view or reproduce the image. Upon any violation of any of the provisions of this Agreement, rights to use any images shall automatically terminate and the images must be returned to Dragonfly Photography, LLC or all copies of the images destroyed.LIMITATION OF LIABILITY. THE WARRANTIES SET FORTH IN THIS AGREEMENT REPLACE ALL OTHER WARRANTIES. DRAGONFLY PHOTOGRAPHY, LLC EXPRESSLY DISCLAIMS ALL OTHER WARRANTIES, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT OF THIRD-PARTY RIGHTS WITH RESPECT TO THE DOCUMENTATION AND IMAGES. NO DRAGONFLY PHOTOGRAPHY, LLC DEALER, AGENT, OR EMPLOYEE IS AUTHORIZED TO MAKE ANY MODIFICATION, EXTENSION, OR ADDITION TO THIS WARRANTY. IN NO EVENT WILL DRAGONFLY OR ITS SUPPLIERS BE LIABLE FOR ANY COSTS OF PROCUREMENT OF SUBSTITUTE PRODUCTS OR SERVICES, LOST PROFITS, LOSS OF INFORMATION OR DATA OR ANY OTHER SPECIAL, INDIRECT, CONSEQUENTIAL OR INCIDENTAL DAMAGES ARISING IN ANY WAY OUT OF THE SALE OF, USE OF OR INABILITY TO USE ANY DRAGONFLY PHOTOGRAPHY, LLC PRODUCT OR SERVICE, EVEN IF DRAGONFLY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO CASE SHALL DRAGONFLY'S LIABILITY EXCEED THE ACTUAL MONEY PAID FOR THE PRODUCTS AT ISSUE. THE PURCHASER=S SOLE REMEDY SHALL BE A REFUND OF THE PURCHASE PRICE.
